Clear sailing agreement
Definition:
An agreement made between counsel for plaintiffs and defendants during or after a settlement negotiations on the claims of a class whereby the defendant agrees not to object to a fee request of the counsel representing the plaintiff class.
Certified hearing
Definition:
During a certified hearing, the court listens to the arguments of the counsel and decides whether the case is ?worthy? to be continued as a class action.
Notice
Definition:
A court-ordered document that informs class members of the nature of proceeding and their rights and responsibilities in the litigation.
